Attached above is a Motion To Compel that American and US Airways just filed with the court hearing the DOJ’s lawsuit. The title of the motion really speaks for the issue:

During the lawsuit process our antitrust lawyers requested documents from the DOJ that the Dept. used to justify approving past airline mergers. Hearing or seeing nothing from the DOJ about the request, our legal team filed the Motion to Compel this morning. Bloomberg (see below) has already reported on the motion and you will see other news articles throughout the day. Thank you.

Update on Equity Distribution Eligibility Notices

The Equity Distribution Committee is continuing to revise initial eligibility determinations to correct errors in the information received from American.  As you were previously advised, the data we received regarding years of service with AA in a TWU represented craft/class was not accurate for approximately 4,700 employees.  Revised notices of eligibility with correct years of service information are being sent to all of the affected employees by First Class Mail on September 20, 2013.

Dear Brothers & Sisters: Update on AA Equity Distribution Mailings – September 6, 2013

It has come to our attention that notices of eligibility that were sent to some TWU represented AA employees did not have correct data for years of service  with AA in a TWU represented craft/class. Those notices were based on information from the Company which the TWU Equity Distribution Committee has determined to contain inaccuracies. The information from the Company has been reviewed and we have located the source of the inaccuracies. It is important to note that qualifying time is determined strictly by time in the TWU at AA.

Court Updates

September 24, 2013

The Court conducted the thirty-sixth omnibus hearing today.  The main item on the agenda was  a pretrial conference in the case of Fjord v. AMR Corporation, Adv. Pro. No. 13-1392.  The plaintiffs in this action allege antitrust violations under section 7 of the Clayton Act.  This is a separate action from the one brought by the Department of Justice and the Attorneys General pending in the District Court in Washington D.C..  After extensive argument the Court determined that the District Court action should be heard and determined first, with this private action proceeding after the District Court has rendered a ruling.  In the event of a settlement of the District Court action, the parties are to return to the Bankruptcy Court to discuss scheduling.
